The questioner : He says: O honorable Shaykh, we doctors suffer from two things, and I hope you will answer: First: Sometimes we are asked to persuade the guardian of a patient who has suffered brain death to donate his organs. Is that permissible? And is organ donation permissible?
Second: We are also asked to perform some cosmetic surgeries, such as nose jobs, liposuction, breast reduction or enlargement, and so on. What is the ruling on these surgeries? And what is the criterion? May Allah guide you, reward you with good, and make you beneficial.

The Shaykh : Ameen. As for the first one, which is donating the organs of a deceased person, this is haram and not permissible. This is because Allah (Glorified and Exalted is He) made the human body a trust with Him, a trust with the person. He said, Mighty and Majestic:
And do not kill yourselves [or one another] وَلا تَقْتُلُوا أَنْفُسَكُمْ
[An-Nisa 4:29]
There is no difference in donating organs between life and death. This means that a living person is not allowed to donate any of his organs, and a deceased person is not allowed to donate any of his organs. His awliya (guardians) do not have the right to donate any of his organs after his death. This is because the awliya inherit what? Money, not organs. Money. As for the organs of the deceased, they are respected. Even if the heirs permit cutting the organs of the deceased to donate them, it is not permissible. In fact, the fuqaha (jurists) (may Allah have mercy on them) said in their books, in the book of funerals: “It is not permissible to take anything from his organs, even if he bequeathed it”. Even if the patient bequeathed that something be taken from his organs, it is not permissible to carry out his will. This is because the human body is a trust. And the Prophet (peace and blessings be upon him) said:
Breaking the bones of the deceased is like breaking his bones when he is alive. كسر عظم الميت ككسره حياً

Just as it is not permissible to break the bone of a living person, it is not permissible to break the bone of a deceased person. And how much corruption has occurred because of organ donation! We have heard in some countries that they come to the children in the markets, snatch them, and slaughter them, rushing to take the livers and the kidneys to sell them. They are beasts. Therefore, we see that this is haram and not permissible, even if the deceased bequeathed it. And if he did not bequeath it, it is even more severe. Even a living person is not allowed to donate. If your son, or your father, or your brother, or your sister needed a kidney, it is not permissible for you to donate your kidney to him. It is haram for you.
First: Because the kidney taken from its place and transplanted to another place may succeed or may not succeed. Even if success is the most likely outcome, it is permissible that it may not succeed. And you have now committed a harm, which is what? Removing this kidney from the place where Allah placed it to a place where it may succeed or may not succeed. And if success is the most likely outcome, the harm is certain.
Second: Do you have knowledge that the remaining kidney will remain healthy until you die? Answer, people? No. Perhaps the remaining kidney will become diseased. If it becomes diseased, there is nothing to compensate for it. You will have been the cause of killing yourself. And on this basis, it is not permissible to donate kidneys absolutely, nor the liver absolutely, nor any organ absolutely, neither in life nor after death.
Now, if someone says: What about blood? We say: There is nothing wrong with donating blood when there is a need, on the condition that no harm comes to the donor. The difference between blood and an organ is that blood is replaced, whereas an organ is not replaced. As soon as the blood is taken from him, he is given nutrition, and the blood returns, by the permission of Allah (Mighty and Majestic). But an organ, once lost, does not return.
As for the matter of beautification that was mentioned, beautification is of two types: The first type is removing a defect, and the second type is increasing beauty. – Pay attention to this, my brother – The first type is removing a defect. And the second is what? Increasing beauty.
As for the first, removing a defect is permissible. This means, if a person’s nose is crooked, if a person’s nose is crooked, it is permissible for him to have surgery to correct it. Because this is what? It is not beautification; it is removing a defect. The nose is not normal; it is crooked, and he wants to correct it. Similarly, a man who is cross-eyed. Is being cross-eyed a defect or not? It is a defect. Yes, being cross-eyed is undoubtedly a defect. If a person wants to have surgery to correct the defect, is it permissible or not? It is permissible. There is no obstacle. This is removing a defect. Now, if a person’s nose is cut off in an accident, is it permissible to attach a nose in its place? Yes, it is permissible. Because this is removing a defect. And this incident occurred during the time of the Prophet (peace and blessings be upon him).
The nose of one of the Companions was cut off in one of the battles. So the Prophet (peace and blessings be upon him) said: Make for him a nose. Or the man made for himself a nose of silver. It was attached to the nose. So the silver became foul. Silver becomes foul. It had a bad smell. So the Prophet (peace and blessings be upon him) permitted him to make a nose of gold. So he made a nose of gold. قطع أنف أحد الصحابة في حرب من الحروب، فقال النبى عليه الصلاة والسلام اجعل عليه أو الرجل جعل عليه أنفاً من فضة، ركب على الأنف، فأنتنت الفضة، الفضة تنتن، صار لها رائحة كريهة، فأذن له النبي صلى الله عليه وسلم أن يتخذ أنفاً من ذهب فاتخذ أنفاً من ذهب
So we say: Is this beautification or removing a defect? It is removing a defect. This is permissible. Similarly, if a lip is split, it is permissible to join the parts together because this is what? Removing a defect.
As for the second type, it is increasing beauty. This is what is not permissible. For this reason,
Narrated Asma': (the daughter of Abu Bakr) Allah's Messenger (ﷺ) has cursed such a lady as artificially lengthening (her or someone else's) hair or gets her hair lengthened. لعن النبي صلى الله عليه وسلم المتفلجات للحسن

The women who file their teeth for beauty, meaning that they file their teeth so that they become separated and spaced out for beauty. The Messenger (peace and blessings be upon him) cursed that. And he cursed the woman who joins her short hair with hair, and the like of that. It remains for us to look at the surgery for enlarging or reducing the breast. Is it permissible or not? This is beautification. This is beautification. Except if a woman has a small breast and wants it enlarged so that it can hold more milk, meaning: so that her breast is small and does not satisfy her child. In this case, we might say that there is nothing wrong with it. But for beautification, it is not permissible. So this is the criterion, my brother the doctor, the criterion for the issue of beautification. So beautification is how many types? Two types: The first is for removing a defect, and this is permissible. And the second is for increasing beautification, and this is not permissible. Yes.
