The Shaykh : This question involves two issues. The first issue is swearing on the mushaf to confirm the oath, and this is a form for which I do not know any basis in the Sunnah, so it is not prescribed.
As for the second issue, it is his oath, or her oath, to lie while knowing it, and this is a great sin. He must repent to Allah from it. Some scholars even say that this is one of the oaths that plunges its owner into sin and then plunges him into the Fire. If this oath occurred from him after he reached maturity, then by that he becomes sinful, and he must repent to Allah. He does not have an expiation, because the expiation is only for oaths regarding future matters. As for past matters, there is no expiation in them; rather, the person is in a state of uncertainty between being sinful or not sinful. If he swore about something he knows is a lie, he is sinful. If he swore about something he is convinced is true, or he knows is true, he is not sinful. Yes.
