The questioner : I have often read in some Arabic magazines and also heard from some scholars in my country that the jewelry worn by a woman is not subject to zakah, and that zakah is obligatory only on gold that is in the form of ingots. However, due to my constant listening to this program, *Nur 'ala al-Darb*, I learned that zakah is obligatory on a woman's jewelry. The question here is that my mother owns jewelry exceeding the nisab, and it has been in her possession for more than ten years or more. I asked her to pay the obligatory zakah. What is the ruling on the previous years in which she did not pay zakah due to her ignorance? Please inform us, may Allah reward you.
The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and all his Companions. The questioner says that he previously understood that zakah is not obligatory on gold unless it is in the form of ingots. This understanding of his is an understanding of part of the issue, because if the gold is in the form of ingots, zakah is due on it, and if it is in the form of currency, such as dinars, zakah is due on it, and this is a known matter among the scholars. The scholars differed, however, on whether zakah is due on jewelry made for use or for lending. The correct view is that zakah is obligatory on it, which is the position of Abu Hanifah and one of the two narrations from Ahmad, based on the indications of the Book and the Sunnah. There is no need to cite the evidence, as the listener has already understood them and knows that zakah is obligatory. However, he asks whether zakah is obligatory on him for the past years in which he did not believe zakah was due. The answer to this is that zakah is not obligatory on him for the past years, because he did not believe it was obligatory not out of ignorance on his part, but out of following some of the scholars whom we are commanded to follow when we do not have knowledge, as Allah the Exalted said:[An-Nahl 16:43] So, as long as in the past he did not pay zakah on the jewelry, following the scholars who say that zakah is not obligatory on it, then he is not required to pay zakah for the past. However, he is required to pay zakah from the time he learned that the correct view is that paying it is obligatory, and the lunar year (hawl) begins from the time of learning the obligation. If he pays the zakah immediately upon learning it, that is better. Yes.
The questioner : May Allah bless you. The listener is Jamal 'Abd al-Ahmad, a Yemeni teacher in al... He says in his message.
