Question:
Your Eminence! This sister, the questioner (H. M. Sh.) from Riyadh, asks: Is there zakah in jewelry worn for adornment? And if there is disagreement among scholars regarding a certain issue, which opinion should I adopt and act upon? Please issue a ruling on this, and may Allah reward you.

Answer:
The correct view is that there is zakah in it. There is zakah in gold and silver jewelry; this is the correct view. Some scholars do not consider there to be zakah in it, but the correct view is that there is zakah in it, provided it reaches the nisab and a lunar year has passed over it. One must pay zakah on the gold or silver, which is one-quarter of a tenth, i.e., 2.5 percent. For gold, if it is one hundred pounds, it is one hundred and a half pounds, meaning one-quarter of a tenth. This is the obligatory amount, and this is the correct view.
And if scholars disagree, it is obligatory to follow the evidence. The one who has evidence from the Qur'an or the Sunnah is the one who must be followed; for Allah the Exalted says:
And if you disagree over anything, refer it to Allah and the Messengerفَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ
[Al-Nisa: 59]. So if scholars disagree on something, it is obligatory to refer to the Qur'an and the Sunnah. The Sunnah indicates that there is zakah in jewelry. The Prophet (peace and blessings be upon him) clarified that there is zakah in gold and zakah in silver. He saw a woman wearing jewelry and said:
Do you pay its zakah?أتؤدين زكاتها؟
She said: No. He said:
Are you pleased that Allah may put two bangles of fire on your hands?أيسرك أن يسورك الله بهما يوم القيامة سوارين من نار؟
