The Shaykh : My view on shighar marriage is that it is forbidden, due to the prohibition of the Prophet (peace and blessings be upon him) of it, as in the hadith of Ibn 'Umar and as in the hadith the questioner referred to, where he said: "There is no shighar in Islam". Shighar is when a man marries off his female relative on the condition that the other man marries off his female relative to him without a mahr, or a small mahr is named for them as a ruse. Shighar was made forbidden and invalid because Allah the Exalted said:
And lawful to you are [all others] beyond these, [provided] that you seek them [in marriage] with [gifts from] your property وَأُحِلَّ لَكُمْ مَا وَرَاءَ ذَلِكُمْ أَنْ تَبْتَغُوا بِأَمْوَالِكُمْ
[An-Nisa 4:24]
Thus, Allah the Exalted made the permissibility of a woman conditional upon the payment of money. And so it came in the hadith from the Prophet (peace and blessings be upon him) that he prohibited shighar marriage. Yes.
