The questioner : The listener Ali al-Rish from Libya says: We performed the Maghrib prayer in congregation, and the prayer ended. Then a group of people entered and they also established the prayer in congregation with another imam. Is the second congregational prayer valid or not? Please inform us, may Allah reward you.
The Shaykh : Yes. The second congregational prayer that comes after the first congregation has finished its taslim, or that comes after the first congregation has finished its prayer, is valid. If a group of people enters the mosque and the people have already finished their prayer, then they establish the congregation among themselves, because the Prophet (peace and blessings be upon him) said regarding a man who entered while the people had already prayed:Sunan ad-Daraqutni 3:175 So a man from among the people stood up and prayed with him.
Establishing a second congregation after the first congregation takes two forms. The first form is for it to be a regular, permanent practice such that it is known that there are two congregations in this mosque. This is a religious innovation (bid'ah), and it was not the way of the Messenger of Allah (peace and blessings be upon him) and his Companions, and it is to be forbidden.
The second situation is for the second congregation to be incidental due to a need, such as a group of people entering after the first congregation has finished the prayer. In that case, they may pray in congregation, and there is no blame on them for it, nor is it a religious innovation (bid'ah) on their part.

Is there a man who will stand up and be given charity?
