The questioner : The listener, your brother in Allah, M.S.A. from southern Yemen, Hadramaut, says in this question: Noble Shaykh, in our desert region, the contract is delayed after the completion of the marriage, and also the contract is not completed until the delivery of the *funun*, which is a set of clothes distributed to the girl's relatives, such as the paternal uncle, maternal uncle, maternal aunt, paternal aunt, and others. Now, money has replaced the clothes. After the contract, the husband and wife distribute the aforementioned *funun* to the relatives, and the relatives give them approximately sheep equivalent to this value. What is the ruling on this practice? Please issue a ruling, may Allah reward you?

The Shaykh : I see no harm in this practice because it does not contain anything forbidden; rather, these are customs, and the original ruling for customs is permissibility, except for what the Shari'ah indicates as forbidden.
As for delaying entering the woman after the contract, it is up to the two spouses. If they wish, they delay the entry, and if they wish, they hasten it. If they do not specify hastening or delaying, the matter is referred to custom, and there is no harm in hastening the entry, even if they had delayed it, provided it is with their mutual consent. For example, if it is stipulated for the husband after the contract that he not enter her until after six months, for instance, and then both parties agree that he enters her in the first month, there is no harm, because the matter is up to them. What I love and prefer is that the entry follows the contract, meaning that the contract and the entry occur in close proximity, because that is better, more appropriate, and further from problems in case a divorce occurs, or separation by death, or the like.
