Q: A question from: L. A. He says: I work as a marriage officer, and I have heard from some of those who claim to be scholars that the marriage contract between two spouses, one of whom does not pray, is invalid, and that it is not permissible to contract the marriage for them. Is this correct? And what should I do if I am asked to perform a marriage contract? Should I ask about the condition of the spouses regarding their prayer? Or should I perform the contract without asking? Please give us a ruling, may Allah reward you.
A: In the name of Allah, and all praise is due to Allah. If you know that one of the spouses does not pray, do not contract the marriage for him with the other; because abandoning the prayer is disbelief; due to the saying of the Prophet (peace and blessings be upon him):
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
which Muslim recorded in his Sahih, and the saying of the Prophet (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر
