The Ruling on the Marriage Contract of a Husband and Wife Who Abandon Prayer

Machine translationRead the Arabic original
Question:
What is your opinion, Your Eminence, regarding the continuation of the marriage between a husband and wife who do not pray? Does their marriage contract become invalid? And if they return and repent to Allah and stand for prayer, is the contract renewed, or not?

Answer:
If both of them do not pray, the contract is valid, like the contracts of disbelievers. But if the husband does not pray and she prays, or he prays and she does not pray, the contract is not valid; it is renewed. This is because abandoning prayer is disbelief according to the correct opinion. So the contract is renewed after the repentance of the one who does not pray.

Question: Meaning, if they return to prayer, the contract is renewed?

Answer: The contract is renewed. And before that, she is prevented from him and he is prevented from her.
