The Shaykh : We return now to the one who smokes while fasting. This is combining the two calamities, combining the two acts of breaking the fast. Then, regarding what he put into his stomach, I wanted to say it is purer, but where does its purity come from? But I will soften my words if I say it is purer to him than the clear water that came down from the water of the sky. It is purer to him, as evidenced by the fact that he breaks his fast with it, but he does not break his fast with sweets, or with water, or with anything else. So, there is no indication in the Shari'ah that one sin is greater than another. We say the greater sin has no harm in it, and the lesser sin has all the harm. This is as Ibn Taymiyyah (may Allah have mercy on him) said: there is no such contradiction in the Shari'ah, such a contradiction, meaning that the worse is without harm and the better has all the harm. This does not exist in Islam at all. And this is among the meanings of his saying (peace and blessings be upon him): Sahih Muslim 1037a For example, when the means leading to a goal that is forbidden are themselves forbidden, the goal becomes a greater sin than the means, because the means is a prerequisite, so it is inconceivable that the means is more forbidden than the goal; rather, the opposite is correct. Likewise, it is inconceivable that a person drinks water, which breaks the fast, and the more pleasant thing to him, if you give him the choice between water and smoking, is that he chooses smoking, and it is said that this does not break the fast. So, this smoker will live through the entire day of fasting while smoking while fasting, if Allah wills. He disobeys Allah (Mighty and Majestic). The one who drinks water disobeys Allah only because he contradicted Him in that Allah said: [Al-Baqarah 2:187] But if he drinks alcohol, he disobeys Him twice, because he disobeys Him by putting a fast-breaking substance into his stomach first, and then he disobeys Him by drinking something forbidden. This is like the smoker about whom the question was asked: does one who smokes in Ramadan break his fast or not? The answer is: he breaks his fast more severely than the one who breaks his fast with water.
