If a man wishes to divide his wealth among his children during his lifetime, should he divide this wealth as inheritance, giving the male the share of two females, or should he divide it...

Machine translationRead the Arabic original
The Shaykh: Yes.

The questioner : Regarding the issue where a man wishes to give to his sons and daughters, meaning he divides what he has of property, for example, does this require equal distribution during his lifetime, or is it as it is after his death?

The Shaykh : Do you mean division?

The questioner : Males and females.

The Shaykh : Yes, in the manner of...

The questioner : ... .

The Shaykh : Listen, may Allah bless you, do you mean division as inheritance before its cause occurs, or division as a gift or donation?

The questioner: This is my question.

The Shaykh : What is your question? Define your question. What do you mean by division of inheritance?

The questioner : Like this.

The Shaykh : Or division as a gift?

The questioner : And my question is whether it is division of inheritance or not inheritance.

The Shaykh : Glory be to Allah, I do not know what it is. It may be division of inheritance from a person, and this has happened repeatedly and often, and it happened with my in-laws, so I advised them to return it, and they complied, and may Allah reward them with good. It also happens in the context of gifts and donations. So if it is in the context of division, it is not permissible to divide the inheritance, meaning in the context of dividing inheritance, it is not permissible. And if it is in the context of gifts and donations, it is permissible, but equal distribution is required, due to his saying (peace and blessings be upon him):
Be just among your children اعدلوا بينَ أولادكم
.

The questioner : I intended, my Shaykh, regarding the male and the female.

The Shaykh : And what did I intend?

The questioner : I mean the equal distribution here.

The Shaykh : What you intended, what you intended, if the division is division of inheritance while the testator is alive, it is not permissible. And if the division is in the context of gifts and donations, then equal distribution among the children, males and females, is required, so the system of inheritance where the male gets the share of two females is not applied here.

The questioner : May Allah reward you with good.

Another questioner : We understood from you that it is not permissible to divide the inheritance during his lifetime. Does this mean that dividing the inheritance is dividing everything he owns, or if he divides a part, is it also called division of inheritance?

The Shaykh : It is not permissible in the name of inheritance, meaning giving the male the share of two females in the name of inheritance, whether it is all or a part.

The questioner : May Allah reward you with good.
