But we do not need to argue with such a hadith after it has been established that circumcision is part of the fitrah (innate natural disposition); mentioned in this regard—peace and blessings be upon him—traits shared by women and men; such as plucking the armpit hair, shaving the pubic hair, cutting the nails, and among them is circumcision. So when circumcision was mentioned among the fitrah traits, that was evidence that circumcision is not exclusive to men over women. And because it is part of the fitrah first, and was mentioned in a group of other traits; women must share with men, especially since the Prophet (peace and blessings be upon him) used to say: Sunan Abi Dawud 236; so women are not excluded from the rulings that came mentioned for men, and there is no text that includes women; so this text—which is his saying (peace be upon him): Sunan Abi Dawud 236—includes women in all rulings except—along with men—except what the wise Lawgiver has excluded, and the exceptions are known and limited.
How then if circumcision actually took place in the time of the Prophet (peace and blessings be upon him)? There was a circumciser among the female Companions, a woman from the noble female Companions, and she was Umm Atiyyah (may Allah be pleased with her), and she used to circumcise women, so the Prophet (peace and blessings be upon him) ordered her and said to her:—meaning, if you circumcise—; meaning: do not exaggerate in cutting the piece that comes out at the woman's private part. This piece, the people of knowledge say, is like the comb of a rooster, and this is a piece of flesh that grows and shrinks; it varies according to hot countries and cold countries. And there is no doubt that the Arab countries, especially the Hijaz among them—as you witness—are among the hot countries, so the women there are in need of circumcision and reduction. So the Prophet (peace and blessings be upon him) ordered this Umm Atiyyah that when she circumcises women, she should not exaggerate in cutting that piece; he said (peace be upon him): —or as he (peace and blessings be upon him) said.
So the operation of circumcision for women is established practically in the time of the Messenger (peace be upon him) from one side, and included in the generality of the texts from another side, as we mentioned earlier.
But it is necessary to note what I pointed out earlier; that in some countries this piece of flesh does not exist in cold countries, so the women there are not in need of circumcision. So whoever lives or was born in cold countries, and her mother knows that she is in need of circumcision; then circumcision on the seventh day is the best; whether it is a male or a female. And whoever does not need circumcision—for what we mentioned earlier—then there is no need for it, like the rare man who is born circumcised; so he is not in need of circumcision; because the intended thing is cutting that extra piece of skin surrounding the glans, but if he was born circumcised; then there is no need to perform circumcision again; because it is from the category of obtaining what is already obtained, and this has no benefit.
