The questioner : He sent his wife to her family, and after a period of time he asked for her to return, so the messenger said to him: She refuses to come, so he divorced her, and upon investigation she said: "I did not say that," and it was the third divorce; does it count?

The Shaykh : She said: I did not say that?

The questioner : I did not say that to the messenger.

Another questioner : I did not refuse.

The questioner : And at the time, yes, he sent a man to her, the messenger told him: She refused, but she said: I did not say this to the messenger, I did not refuse, meaning; does this divorce count?

The Shaykh : This requires a judge to investigate the matter of the woman’s denial that she said: I did not refuse. If it is verified that she did not refuse, and that the intermediary was lying about her; then the divorce does not take place in this case; because it resembles the divorce of a coerced person.
