The questioner : Travelers entered a mosque in the city and found the resident imam in the Zuhr prayer, so they joined him in the Zuhr prayer. The question is: Is it prescribed for them to perform the 'Asr prayer in congregation in that mosque, which has a regular mu'adhdhin and a regular imam?

The Shaykh : The answer is: If the mosque is still full of worshippers, it is not permissible, for fear that they will understand what is not prescribed to be prescribed, so they should pray individually. But if they move to a corner of the mosque where no one sees them, that is what is prescribed. As for announcing it like this, especially since most people today do not know that repeating the congregation in a mosque that has a regular imam and a regular mu'adhdhin is not known to be that this second and third congregational prayer is not prescribed, as Imam al-Shafi'i and others said. He said in his book "Al-Umm", and he was discussing this issue and providing evidence for it sometimes by reasoning and sometimes by report, saying: "And we have preserved that a group of the Companions of the Prophet (peace and blessings be upon him) missed the prayer with the congregation, so they prayed individually, although they were able to gather again, but they did not do so because they disliked to gather in the mosque twice." So most people today do not know this ruling, as you see in all the mosques, the regular official imam hardly finishes his taslim until the prayer is established here, and hardly does this one finish until another prayer is established. This is from the division of the religion which the Lord of the Worlds forbade when He said:
and do not be of those who associate others with Allah (32) [Or] of those who have divided their religion and become sects, every faction rejoicing in what it has. ولا تكونوا من المشركين من الذين فرقوا دينهم وكانوا شيعا كل حزب بما لديهم فرحون
[Ar-Rum 30:31-32]
The first congregational prayer is the one intended by the texts that came regarding it, whether in the Noble Qur'an, such as His saying, Mighty and Majestic:
And establish prayer and give zakah and bow with those who bow [in worship and obedience]. وأقيموا الصلاة وأتوا الزكاة واركعوا مع الراكعين
[Al-Baqarah 2:43]
This verse does not intend anything but the first congregation, and His saying, peace and blessings be upon him:
The prayer in congregation is twenty five times superior to the prayer offered by person alone. صلاة الجماعة تفضل صلاة الفذ بخمس أو بسبع وعشرين درجة

This is the first congregation, as for the second congregation and so on, this is not prescribed for two reasons previously mentioned: the first is that it was not the practice of the Companions, and the second is that it involves dividing the religion. Prayer is undoubtedly one of the pillars of Islam, as is well known. So all Muslims should strive for the first congregational prayer. If they miss it, there is no doubt that this missing is either due to an excuse or without an excuse. If it is due to an excuse, he (peace and blessings be upon him) said:
Whoever performs wudu' in his house and perfects his wudu', then goes to the mosque of the congregation and finds that they have already prayed, Allah writes for him the like of their prayer or the like of the reward of their prayer, without diminishing anything from their rewards. من توضأ في بيته فأحسن وضوءه ثم أتى مسجد الجماعة فوجدهم قد صلوا كتب الله له مثل صلاتهم أو مثل أجر صلاتهم دون أن ينقص من أجورهم شيئا

So, if he is excused, there is no justification for him to repeat the second congregation, because the reward has already been obtained for him. And if he is not excused, and he was occupied with the first congregation or distracted from the first congregation by his trade, his selling, his buying, or his laziness regarding it, and then he wanted to make up for what he missed of the reward, or rather what he missed of carrying out the command, then alas, alas, there is no room for him for such making up.
