The tubban in the Arabic language is what is called today the short pants, meaning the pants that have no sleeves; this is the tubban. So Lady Aisha did not see any harm in a pilgrim wearing the tubban. It is to be noted that the tubban is a type of trousers. It has come in the authentic hadith in al-Bukhari and Muslim that it is not permissible for a person in the state of ihram to wear trousers, nor a turban, nor a shirt, meaning it is not permissible for him to wear any garment tailored to fit his body. This is, of course, a ruling specific to men, not women; because the ihram of a woman is only in her face and her two hands; that is, a woman in the state of ihram is not permitted to tie a veil over her face, nor is it permissible for her to wear gloves; this is her ihram. And this is from Allah's (Mighty and Majestic) facilitation for women. As for the man, it is not permissible for him to wear trousers. We find that Lady Aisha permitted wearing the tubban, which is the short pants as we said.
The scholars interpreted Lady Aisha's statement to mean that she did not see any harm in a person in the state of ihram wearing this short garment to cover his 'awrah if he was exposed to it being revealed. So Lady Aisha permitted this type of person in the state of ihram to wear the tubban from the perspective of averting the greater harm by the lesser harm, and nothing else. Therefore, it is not taken from Lady Aisha's words that wearing the tubban is permissible for a person in the state of ihram absolutely, but only for the sake of need.
