The questioner : Regarding staying overnight in Muzdalifah and standing at 'Arafah, the fatwa we hear from some of our brothers, may Allah reward them with good, in this matter, whether in Hajj there or here, is that passing through Muzdalifah is sufficient, or that after midnight, if you go early, it is permissible for you to leave it for Mina.

The questioner : Yes, and likewise for 'Arafah, it is sufficient to stand there, even for a moment. This is a legal maxim.

The Shaykh : As we have been accustomed to, and the excellence is from Allah, first and last, that we do not proceed in what we adopt except from the Book of Allah and the hadith of the Messenger of Allah (peace and blessings be upon him). So regarding their statement that passing through Muzdalifah is sufficient, we say here
Produce your proof, if you should be truthful." هاتوا برهانكم إن كنتم صادقين
[Al-Baqarah 2:111]

The Shaykh : All right, but the evidence for the contrary is that when one of the Companions came to him (peace be upon him) and said to him
I did not leave a rope or a mountain without climbing it until I came and stood at 'Arafah, and I came to Muzdalifah. He (may the prayer and peace of Allah be upon him) said to him: "Whoever prays this prayer of ours with us at al-Jam' (meaning in Muzdalifah, which is the Fajr prayer) and had previously stood at 'Arafah for an hour of night or day, has completed his Hajj and fulfilled his obligations." ما تركت من حبل أو جبل إلا وصعدت عليه حتى جئت وقفت في عرفات وأتيت إلى مزدلفة ، فقال له عليه الصلاة والسلام: من صلى صلاتنا هذه معنا في جمع - أي في مزدلفة هو يعني صلاة الفجر - وكان قد وقف قبل ذلك في عرفة ساعة من ليل أو نهار فقد قضى حجه وتم تفثه
If he had said "passing through," he would have said, "Pray with us this prayer of Fajr." He had previously stood at 'Arafah for an hour of night or day, so his Hajj is complete and he has fulfilled his obligations. Therefore, we say that passing through Muzdalifah is not sufficient, nor is staying overnight in Muzdalifah and departing at midnight sufficient, because this is a specific ruling for women, the gentle sex as they say, and I say now the weak sex. Therefore, they were granted a dispensation to depart after midnight. As for the sex they call today the coarse one, which is the strong man, he was told:
Do not stone the Jamrah until the sun has risen. لا ترموا الجمرة حتى تطلع الشمس

So, those who pray Fajr in Muzdalifah, even if they did not stay overnight there, and if they leave staying overnight in Muzdalifah, they have contradicted the Sunnah. But if they perform this Sunnah and leave the prayer there in Muzdalifah, they have contradicted a pillar.

The questioner : Look, O Shaykh, what is happening in Hajj is very serious.

The Shaykh : Yes, this is due to the negligence of the state.

The questioner : Will people be held accountable for this, O Shaykh?

The Shaykh : By Allah, generally, we cannot say they are held accountable or not. This varies depending on the person who was eager to pray Fajr in Muzdalifah. He was not here or there; he had in mind that he would pray, but was prevented from doing so because of the guards, these ignorant oppressors.

The questioner : The issue is not the guards, but rather the fatwa of the Shaykhs. Unfortunately, we were Sunnis who went to Hajj with the Waqf.

The Shaykh : Yes, that is correct.

The questioner : And they were issuing fatwas to people, meaning very strange fatwas in these matters. For example, regarding Muzdalifah, leaving after midnight, it is permissible for you to leave. This is the weak opinion. On this basis, you leave. Wait, O Shaykh, wait. Every time I bring it up, I get it.

Another questioner : For the sake of Muzdalifah... Muhammad 'Aqla says, "People, my brothers, staying overnight in Muzdalifah is not intended in Hajj. The Messenger of Allah (peace and blessings be upon him) descended from 'Arafah and reached Muzdalifah. He was tired, drowsy, and slept. If he had had the strength, he would have kept walking to Mina."

The Shaykh : I seek refuge in Allah.

The questioner : I said to him, "O Shaykh, how can you say
But when you depart from 'Arafat, remember Allah at al- Mash'ar al-Haram. فإذا أفضتم من عرفات فاذكروا الله عند المشعر الحرام
[Al-Baqarah 2:198]
" He said, "You understand the apparent text, but you do not understand the spirit of the text." I seek refuge in Allah, O Shaykh. This is not what he said, by the great Allah. I have never heard such a fatwa before. There is a difference between telling people it is not obligatory and leaving a pillar. Some scholars called it a pillar.
