Praise be to Allah alone, and may prayers and peace be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the honorable Director of the Dawah and Guidance Center in the Jazan region, Shaykh: Ahmad ibn Ali Zar'i, under number (10 9 Z) and dated 4/1/1428 AH, containing the question submitted by (A. H. A. H.) and referred to the Committee by the General Secretariat of the Council of Senior Scholars under number (134) and dated 24/1/1428 AH. The questioner asked a question, the text of which is as follows: I performed Hajj this year, 1427 AH, and on the ninth day—which is the Day of 'Arafah —after the sun had set, we departed by bus from 'Arafah to
Muzdalifah , where we faced difficulties in travel, as we remained from after sunset until 2:00 AM without reaching Muzdalifah. So I got off the bus and took my mahram relatives to proceed to Muzdalifah. On the way, we found a sign that read "Route No. (3) Muzdalifah" with an arrow pointing downward, so I thought it was Muzdalifah. I found a man in whom I saw good and asked him about Muzdalifah, and he said to me: "You are in Muzdalifah." There was another sign in front of me, far away, and I could not read what was written on it. He said: "This sign is at the end of Muzdalifah." So I prayed Maghrib and 'Isha, even though I had already prayed Maghrib and 'Isha earlier next to the bus before going to Muzdalifah. I slept until Fajr and prayed Fajr. After the sun rose, and on my return to the camp in Mina, it became clear to me that the sign was the beginning of Muzdalifah. So I asked the security man, and he told me: "The place where we were is not Muzdalifah." I do not know the place, but I exerted myself to stay overnight in Muzdalifah. So is there anything upon me, O His Eminence the Mufti? And is a fidyah obligatory upon me or not?

After studying the inquiry, the Committee answered: The Prophet (peace and blessings be upon him) is established to have stayed overnight at Muzdalifah and prayed Fajr there, and remained until it was very light, and he said:
Take from me your ritesلتأخذوا عني مناسككم
Narrated by Muslim. In the hadith of 'Urwah ibn al-Muththir, (may Allah be pleased with him), he said: The Messenger of Allah (peace and blessings be upon him) said:
Anyone who offered this prayer -at al-Muzdalifah- along with us, and waited with us until we returned to Mina, and he stayed at 'Arafat (on the 9th ) before that by night or day, he would have completed the prescribed duties of Hajj.من شهد صلاتنا هذه - يعني بالمزدلفة - فوقف معنا حتى ندفع وقد وقف بعرفة قبل ذلك ليلاً أو نهارًا فقد تم حجه وقضى تفثه

Narrated by the five, and graded authentic by al-Tirmidhi and Ibn Khuzaymah. Therefore, staying overnight at Muzdalifah on the night of the tenth of Dhul-Hijjah is one of the obligatory acts of Hajj. Whoever leaves the stay overnight at Muzdalifah must offer a sacrificial animal, based on the statement of Ibn 'Abbas, (may Allah be pleased with them both): "Whoever leaves a ritual act or forgets it, let him shed blood." Based on the foregoing, it is obligatory for you to slaughter a sheep and distribute it to the poor of the Haram; because you left the stay overnight at Muzdalifah with a degree of negligence, and the obligatory thing in such circumstances is to be careful and exert oneself in asking the knowledgeable about the boundaries of the sacred sites.
