The questioner : The questioner says: If the husband is absent for several years and the wife has no news of him, and she has requested divorce from the judge of the country and he divorced her, is she required to observe the waiting period at that time?

The Shaykh : Yes, it is obligatory for a woman, if her husband divorces her while he is absent from her for a long time, to observe the waiting period. Likewise, if she is divorced by the judge, she must observe the waiting period. Her waiting period is three menstrual cycles, meaning three periods. If she does not menstruate due to old age, an incident, a disability, or youth, her waiting period is three months, based on the saying of Allah (Blessed and Exalted is He):
And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated
