Q1: If a divorced woman remains in her husband's home after the divorce until the expiration of the period prescribed for her, how is it that the wife remains in her husband's home while she is divorced until the expiration of the period prescribed for her, and how is it that she and her husband are in this house after the divorce?
A1: If a man divorces his wife with a revocable divorce, for example: if he divorces her with one divorce after having intercourse with her, and his divorce of her was without compensation from her, it is obligatory for her to stay in her home with her husband, and it is forbidden for her to leave it as long as she is in the waiting period, and it is forbidden for him to expel her from it until the waiting period expires, except if she commits a clear indecency; because she is in the status of a wife, and he has the right to take her back during her waiting period with the testimony of two just witnesses, even if she does not agree to being taken back, and her return to him does not depend on a new contract, a new mahr, or her consent. However, if a man divorces his wife with an irrevocable divorce, for example: if he divorces her before having intercourse with her, or after having intercourse with her but with compensation, then she becomes a stranger to him by this, and she is not lawful for him except with a new contract and a new mahr with her consent, and taking her back is not sufficient in this case as you wrote in the first case, and it is not permissible for him to be alone with her, nor to see of her except what is permissible for strangers to see of her.
