A hired driver was involved in an accident in which the passenger next to him died, and the insurance company paid a specific sum to the deceased's children. Is it permissible for them to take it?

Machine translationRead the Arabic original
The Shaykh : Yes.
Al-Huwayni: A man was traveling in a hired car, and the driver caused an accident, killing the man riding next to the driver, of course. So they agreed that this deceased man would be insured, meaning the insurance company pays the children of this man who died, about twenty thousand pounds. Is it lawful for them to take this money?

The Shaykh : No, they take the legal blood money from the killer by mistake, if it is available to them. As for taking the money from the company—the insurance company—it is gambling money, and it is not permissible.
Al-Huwayni: What if the man cannot pay the blood money?

The Shaykh : The ruling is the same. But when Muslims are truly Muslims, they cooperate with him, especially his kin from his family. It is obligatory for them to gather what clears his conscience and pay the blood money that the wise Lawgiver has made obligatory upon them. So the absence of such blood money does not justify taking forbidden money. Yes.
Al-Huwayni: May Allah reward you with good.
