The questioner : And we have another type of insurance now, third-party insurance. If a car accident happens and others are harmed, and a person is disabled and can no longer work, you are obligated to support him and provide for his livelihood for the rest of his life, as long as you are the one who disabled him. And if his car is damaged, you repair it?

The Shaykh : You mean you tell the company, or who? Who is the guarantor? The company or the car owner?

The questioner : The car owner is the one who will take responsibility for this.

The Shaykh : And how does he take responsibility?

The questioner : If he does not insure...

The last scenario is the closest to the Shari'ah, like accidental killing, meaning if a person runs over someone on the road and he was the one at fault, he is liable according to the Shari'ah. This is better than participating in insurance, which is the very essence of gambling. As for what is necessitated, know the ruling from what came before.

The questioner : As for those who are compelled to it, Allah is sufficient for them.
