Al-Huwayni: The hadith of Ibn 'Abbas (may Allah be pleased with him and his father): "Whoever leaves a ritual, let him shed blood." What is the authenticity of this hadith? Does it have the ruling of being elevated to the Prophet? And what is intended by the word "ritual" (nask)?

The Shaykh : As for its authenticity, if by "hadith" we mean what you stated in your question, namely that it is a mawquf report, then it is valid in its chain of narration as a report from Ibn 'Abbas, stopping at him. If it is mawquf, then we should look to see if there is anything in the marfu' reports that contradicts it, even in some of its parts, so that we can then decide whether to adopt this mawquf report or not. We have found in Sahih al-Bukhari and elsewhere the story of that Bedouin whom the Prophet (peace and blessings be upon him) saw performing talbiyah for 'Umrah while wearing a jacket and perfumed with fragrance. He said to him (peace and blessings be upon him):
Remove this jacket from you and do in your 'Umrah what you do in your Hajj انزع عنك جبتك هذه واصنع في عمرتك ما تصنع في حجتك
, and the Prophet (peace and blessings be upon him) did not order him to offer a sacrificial animal, even though many scholars today impose such a sacrifice for such a lapse, which is wearing one's regular clothes or applying perfume after entering ihram. When we found that the Prophet (peace and blessings be upon him) did not make obligatory anything of what is implied by the athar of Ibn 'Abbas, we said that we are free from the obligation to act upon this athar, as long as the hadith in al-Bukhari indicates that nothing of blood is required of the ignorant person or the one who errs in one of the rituals of Hajj. Especially since I have practically observed in the Hajj pilgrimages that Allah has allowed me to perform in many past years, that it is rare for a pilgrim to return without being burdened with blood sacrifices, because few escape committing some of the errors for which they are judged to be required to offer a blood sacrifice. Therefore, we say that we are not obligated to act upon this athar of Ibn 'Abbas. Yes.
