Is it permissible to bury on the surface of the ground?

Machine translationRead the Arabic original
The Shaykh: By analogy, this is a religious innovation that contradicts the Sunnah in many respects.

The questioner: Yes.

The Shaykh: Because the Messenger (peace be upon him) used to say:
The niche-grave is for us and the ditch-grave is for others. اللَّحد لنا والشِّقُّ لغيرنا
Sunan Ibn Majah 1554Da’if (Darussalam)
, so if these burial chambers are used such that the dead are buried on the surface of the ground, as we hear happens in Egypt, for example, then this is contrary to the Sunnah; it is neither a lahd nor what? A shiqq. And if the deceased is buried in the body of the earth, the only thing is that a space in the cemetery is reserved, like a room, and this room is not used for burial except for specific individuals, and the land of the cemetery is an endowment; in that case, the error lies in reserving this place for specific people.
So now.

Another questioner: Peace be upon you.

The Shaykh : And upon you be peace and the mercy of Allah.
Do you have here in Jordan, what is the name of the cemetery that?

The questioner : ... .

The Shaykh: In, for example.

Another questioner : ... ؟

The Shaykh: No, no, there are... there are known families who buy land and then they bury what? Their relatives in it.

The questioner: Yes, this has happened; our people did the same thing.

The Shaykh: Where are you from?

The questioner: In Irbid.

The Shaykh : Yes.

The questioner: They bought land and they will bury in it.

The Shaykh: Good; there is nothing wrong with that; because this land is not common property and it is not an endowment for the dead of the Muslims, do you understand? So here, the method of burial must be considered; if the burial is by the method of the lahd, which has been abandoned in this country and in Syria and many other countries, then it is contrary to the Sunnah. So, naturally, I cannot remember every questioner and his question and what my answer to him was, but we have lived for many years and this is our fatwa and these are our opinions.

The questioner: This is what I know, and I informed him of this.

The Shaykh: That is it, so what you know and what you informed him of is the correct thing.

The questioner: But he says he raised a doubt here; he raised a doubt; as if you mean... it is from the perspective of dire necessity, and he said that if we left people to bury each one in a grave, the... and the price of land is very high, it would become a very large area, do you see how? And they took from the agricultural land which, if it were planted, would benefit the living people.

The Shaykh: So what does he intend?

The questioner: Yes, this.

The Shaykh: What does he intend? This speech gives the impression that the question is not the one I conveyed from me.

The questioner: Yes.

The Shaykh: So what does he intend?

The questioner: He intends that this burial chamber is from the perspective of dire necessity; that is his statement.

The Shaykh: What is the burial chamber, my brother, that he is referring to?

The questioner: Burying on the surface of the ground in a place like a room on the surface of the ground.

The Shaykh: This is what we said earlier is contrary to the Sunnah.

Another questioner : ... .

The questioner: About half a meter in length and one meter in height.
... ... ...

Another questioner: ... the men are on one side and the women on the other side, and this, may Allah know best, is contrary to the Sunnah.

The Shaykh: And this is what we said: if it is on the surface of the ground, whether the ground is low or high, the important thing is that a depth of one or one and a half meters must be dug from the earth, and the deceased is buried in the bottom, and then the soil is thrown over him as is the Sunnah; so he is now looking at the issue from the material aspect.

The questioner: The material aspect, yes.

The Shaykh: And the material aspect has ruined the religion entirely; the material aspect is that instead of the woman making a long dress or a long jilbab, she saves money here because it is cheaper for her. We are not concerned with the material aspects; we are concerned with the religious aspects. So if the material and the religion conflict, there is no doubt that the Muslim prioritizes the religion over the material, no matter the value of the material.

The questioner: Okay; here.

The Shaykh: And the best of guidance is the guidance of Muhammad (peace and blessings be upon him and his family).

The questioner : May Allah reward you with good.
