The second question of Fatwa No. ( 349 )
Q2: If a person dies before midnight or after midnight, is it permissible to bury him at night, or is it not permissible to bury him until the dawn breaks?
Part 2: It is permissible to bury a deceased person at night, as narrated by Ibn Abbas (may Allah be pleased with them both), who said:
A man whom the Prophet (peace and blessings be upon him) used to visit while he was ill died, so they buried him at night. When morning came, they informed him, and he said: "What prevented you from informing me?" They said: "It was night, and it was dark, so we disliked causing you hardship." So he went to his grave and prayed over him.مات إنسان كان النبي صلى الله عليه وسلم يعوده، فمات بالليل فدفنوه ليلاً، فلما أصبح أخبروه، فقال: ما منعكم أن تعلموني؟ قالوا: كان الليل، وكانت ظلمة، فكرهنا أن نشق عليك، فأتى قبره فصلى عليه
, narrated by al-Bukhari and Muslim . He did not disapprove of the burial at night; rather, he disapproved of his companions for not informing him of it until morning. When they excused themselves to him, he accepted their excuse. And Abu Dawud narrated from Jabir who said:
Some people saw a fire in the cemetery, so they went to it, and there was the Messenger of Allah (peace and blessings be upon him) in the cemetery saying: "Hand me your companion." And it was the one who used to raise his voice in dhikr.رأى ناس نارًا في المقبرة فأتوها، فإذا رسول الله صلى الله عليه وسلم في المقبرة يقول: ناولوني صاحبكم، وإذا هو الذي كان يرفع صوته بالذكر
, and that was at night, as indicated by the statement of Jabir : (He saw
people a fire in the cemetery...) etc. The Prophet (peace and blessings be upon him) was buried at night. Imam Ahmad narrated from Aisha (may Allah be pleased with her), who said:
We did not know of the burial of the Messenger of Allah (peace and blessings be upon him) until we heard the sound of the shovels at the end of the night, on the night of Wednesday.ما علمنا بدفن رسول الله صلى الله عليه وسلم حتى سمعنا صوت المساحي من آخر الليل، ليلة الأربعاء

. Al-Masahi are the tools used to scrape the earth. Abu Bakr and Uthman and Aisha and Ibn Mas'ud were buried at night. What has been narrated indicating the dislike of burial at night is to be understood as applying when hastening the burial at night interferes with the prayer over the deceased, as mentioned in the authentic hadith, or so that his shroud is not treated poorly, or because it is easier for those accompanying the funeral and allows for better burial and adherence to the Sunnah regarding the manner of digging the grave. This is provided there is no dire necessity to hasten the burial; otherwise, it is obligatory to hasten the burial, even if it is at night. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
