The Shaykh : It is well known that the miqats designated by the Messenger of Allah (peace and blessings be upon him) require every person who passes through them while intending to perform Hajj or 'Umrah to enter the state of ihram from them, because the Prophet (peace and blessings be upon him and his family) commanded this. So if a person passes through them while intending to perform Hajj or 'Umrah, does not enter the state of ihram, and then enters the state of ihram from a place beyond them, then according to the scholars, he owes a fidyah (ransom payment) to compensate for the obligatory act he left off. He must slaughter it in Makkah and distribute it all to the poor, and he must not eat any of it.
As for the scholars’ statement that ihram is a pillar, what they mean by ihram is the intention of the ritual, not that the ihram must be from the miqat, because there is a difference between the intention of the ritual and the intention being from the miqat.
