While we respect the opinions of these people, who issue their fatwas based on some degree of independent legal reasoning, we consider this a grave error. First, they find no scriptural basis for their position other than mere deduction and independent legal reasoning. However, this citation and deduction overlooks other texts that must be considered when issuing such a fatwa. Donating a kidney is either from a living person, which is the common case and the subject of the question and answer, or from a person who died recently, where the kidneys are still considered alive in the opinion of doctors and can be used for a living person, either both or one. In the first case, that is, when one of the kidneys is extracted from a living person as mentioned in the question, it exposes the donor to harm, if not death. I will illustrate this to clarify the answer. If we asked these doctors and those muftis, "Do you guarantee, O mufti, based on the opinion of the Muslim doctor, that this man who will remain with one kidney will not be exposed to its corruption or illness after the removal of its twin, even if not immediately, but after a long, long time?"
