Is ruling by other than what Allah has revealed considered a replacement of the Shari'ah, and is this replacement considered making permissible the ruling by other than what Allah has revealed?

Machine translationRead the Arabic original
Ali al-Halabi: Our Shaykh, for the sake of completing the benefit, since you have graciously given this concise and useful answer, as they say,

The Shaykh : Yes
Ali al-Halabi: It would be desirable, our Shaykh, if you would answer a doubt that is being raised, meaning a hadith, and they have gone bankrupt, and the opponents of our position have gone bankrupt of bringing anything new,

The Shaykh : Yes
Ali al-Halabi: So they began, meaning, to bring the old in a new garment.

The Shaykh : Okay, and he
Ali al-Halabi: They say, for example, that those who rule by other than what Allah has revealed are replacing the Shari'ah [the phone rings], so replacing the Shari'ah on their part is a type of making permissible, not merely ruling by other than what Allah has revealed.

The Shaykh : Keep your question.
Ali al-Halabi: Yes.

The Shaykh : The answer is the same as the previous answer, because in truth, the phrase you quoted today or now from those people is a matter of playing with words. Otherwise, we would say that what they call replacement is either out of conviction that ruling by what Allah has revealed is not suitable for this time, in which case it has been established that this is disbelief and apostasy, or it is not with this disbelieving conviction, or it is following the desire of the self, meaning he is clinging to the chair, and the chair cannot be established for him except by ruling by this law that he found and received from before him, either a disbeliever ruling over the Islamic lands, or from those who succeeded him after him, who consider themselves Muslims. So the important thing is that this replacement is either out of conviction, in which case it is disbelief that takes its owner out of the religion, or it is not out of conviction, but rather he is doing the action of the disbelievers, meaning he rules by other than what Allah has revealed, and this is what Allah has sealed the hearts of the disbelievers with, when He said
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers. ومن لم يحكم بما أنزل الله فأولائك هم الكافرون
[Al-Ma'idah 5:44]
it is those who are the wrongdoers. فأولائك هم الظالمون
[Al-Baqarah 2:229]
they were the defiantly disobedient. فأولائك هم الفاسقون
[Ali 'Imran 3:82]
. Therefore, the scholars of tafsir mentioned that these verses were revealed regarding the Jews who used to send some of their individuals to ask the Messenger, so if his answer agreed with their desires, they would adopt it, otherwise they would say, "We do not believe in this statement." So the answer is the same as the previous answer in truth, but there is a point of attention that it is playing with words.

The questioner : May Allah reward you with good, may Allah bless you.

The Shaykh : And you.
