Otherwise, we would say that what they call replacement is either out of conviction that judging by what Allah has revealed is not suitable for this time, in which case the ruling is that it is disbelief and apostasy, or it is not with that disbelieving conviction, or it is following the desire of the self, meaning he is clinging to the chair, and the chair cannot be established for him except by making this law, which he found and received from before him, the standard, whether that person was a disbeliever ruling over the Islamic lands, or one of those who came after him who consider themselves Muslims. So the important point is that this replacement is either out of conviction, in which case it is disbelief that takes its owner out of the religion, or it is not out of conviction, but rather he is doing the action of disbelievers, meaning he judges by other than what Allah has revealed, and this is what Allah has stamped upon the disbelievers when He said:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers. ومن لم يحكم بما أنزل الله فأولئك هم الكافرون
[Al-Ma'idah 5:44]
Then those are the wrongdoers فأولئك هم الظالمون
Then those are the open sinners فأولئك هم الفاسقون
And therefore the scholars of tafsir mentioned that these verses were revealed regarding the Jews who used to send some of their individuals to ask the Messenger, so if his answer agreed with their desires, they would adopt it, and if not, they would say, "We do not believe in this statement." So the answer is the same as the reality, but with a note that it is playing with words.
