The Shaykh : What I see is that if this person’s wudu' was broken during the tawaf, and if it is possible for him to repeat the tawaf and then the sa'y, that is better. This is because the majority of scholars hold that the tawaf must be performed in a state of wudu'. Therefore, if he can make up for this matter by performing wudu' and repeating the tawaf and then the sa'y, that is more purifying for his conscience and more cautious. However, if it is not possible for him, such as if this man has left Makkah and gone to his country, then he owes nothing, and his 'Umrah is valid. This is because there is no correct, explicit evidence for the condition of wudu' for the tawaf. Consequently, Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) held that it is not required for the one performing tawaf to be in a state of wudu'. But there is no doubt that whenever a person is cautious and follows the path that purifies his conscience in all cases, that is preferable.
