The Shaykh : Excuse me, I do not want to forget that first situation of mine; I did not mention it, so please recall its source.
'Umar al-Ashqar: I do not remember it now, but the picture of it is that in Sham, the governor gave a sum of money to be delivered to al-Khalifiyyah. He gave it to a son of

The Shaykh : 'Umar
al-Ashqar: 'Umar, one of his sons, not 'Abdullah. When they arrived, he said, "This was..." meaning 'Umar was contesting with his son. "By Allah, you are one of the individuals of the Muslims. Take all the money and the profit and buy goods with it, and you profited in it." So he said, "Bring the money and the profit." He said to him, "O Commander of the Faithful, what do you think if I had lost? If I had lost the money now?" He said, "Do you guarantee it?" He said, "The loss would be upon me, and I would have no share in the profit." They said, "O Commander of the Faithful, make it a mudarabah (profit-sharing partnership), with the profit between you and him." So he made it a mudarabah.

The Shaykh : These are judicial matters.
'Umar al-Ashqar: But in the hadith in the Sunan, it says in a hadith that he gave him the choice. Is this a hadith of 'Umar, or from the Messenger of Allah (peace and blessings be upon him)?

The Shaykh : No, it has no connection to 'Umar.
'Umar al-Ashqar: I mean the one who gave the choice, the Messenger of Allah (peace and blessings be upon him).

The Shaykh : The Messenger gave the choice to the child, yes.
