Tafsir of Surat al-Nisa-03a

Machine translationRead the Arabic original
The questioner : What is reported from 'Umar ibn al-Khattab (may Allah be pleased with him) is that whoever takes the property of an orphan must return it. Is this a followed Sunnah from 'Umar? And is the non-return of it something we derived as an understanding from the verse, while this is the explicit statement from 'Umar (may Allah be pleased with him)?

The Shaykh : However, the explicit statement does not take precedence over the verse, because He said:
let him eat فليأكل
Allah has permitted it for him. He did not say: "Let him borrow in a good manner." Furthermore, what is narrated from 'Umar (may Allah be pleased with him) may be that he said it out of scrupulousness, out of scrupulousness only.
