Is the cause of maintenance for the defiant wife intercourse or the marriage contract?

The questioner : In reality, upon reflection, the statement of Ibn Hazm is strong. Many judges here hold that the cause of maintenance for the defiant wife is intercourse, whereas Ibn Hazm established that the cause of maintenance is the marriage contract. So many of our jurists, and many, as soon as the woman leaves the house, they say that maintenance has fallen off her, even though the cause mentioned in the Qur'an is its attachment to the marriage.

The Shaykh : Maintenance is upon whom?

The questioner : Maintenance is upon the husband. It falls off as soon as the defiant woman leaves the house, even though Allah the Exalted made spending obligatory by the marriage contract, not by intercourse. Is this what you consider more likely, or not, O Shaykh?

The Shaykh : In any case, no, by Allah, I am not gathered in my thoughts to enter into this topic, and we need to proceed now... And Glory is to You, O Allah, and praise, I bear witness that there is no god but You, I seek Your forgiveness and I repent to You.
