The questioner : If a man says to his wife, "You are forbidden to me," is she considered divorced?

The Shaykh : She is not divorced. That is, if a man says to his wife, "You are forbidden to me," it is not a divorce and it is not zihar. But it is an oath. Listen to the verse we recited:
why do you prohibit [yourself from] what Allah has made lawful for you لم تحرم ما أحل الله لك
[At-Tahrim 66:1]
. Is a woman among the things Allah has made lawful for him, or not? Answer, everyone. A woman is among the things Allah has made lawful for him. He said:
Allah has already ordained for you [Muslims] the dissolution of your oaths قد فرض الله لكم تحلة أيمانكم
[At-Tahrim 66:2]
. There is no difference between a wife and anyone else. As for those scholars who distinguished between a wife and others, saying that forbidding a wife is zihar and forbidding anyone else is an oath, they have no evidence for this, and the verse is clear.
why do you prohibit [yourself from] what Allah has made lawful for you, seeking the approval of your wives? And Allah is Forgiving and Merciful. (2) Allah has already ordained for you [Muslims] the dissolution of your oaths لم تحرم ما أحل الله لك تبتغي مرضات أزواجك والله غفور رحيم قد فرض الله لكم تحلة أيمانكم
[At-Tahrim 66:1-2]
. It is authentically reported from Ibn 'Abbas (may Allah be pleased with him) that he said:
If a man says to his wife, "You are forbidden to me," it is an oath for which he must make expiation إذا قال الرجل لزوجته أنت علي حرام فهي يمين يكفرها
