On one day, one of the brothers asked me to perform Hajj on behalf of a person I did not know in exchange for a sum of money. I took the money and performed Hajj on his behalf, ignorant of the rules of Hajj.

The questioner : May Allah reward you. This questioner says: “O honorable Shaykh, on one day, one of the brothers asked me to perform Hajj on behalf of…”

The Shaykh : “One of the brothers” — is it “one of” with the damma (nominative) or with the kasrah (accusative)?

The questioner : “One of the brothers” (with the damma).

The Shaykh : Yes.

The questioner : One of the brothers asked me to perform Hajj on behalf of a person I did not know in exchange for a sum of money. I took the money and performed Hajj on his behalf, ignorant of the rules of Hajj, knowing that I had not performed Hajj for myself. After I performed Hajj the second time, I learned that I had not performed a valid Hajj. Am I excused for this ignorance?

The Shaykh : The scholars (may Allah have mercy on them), or rather some of the scholars, say: If a man performs Hajj on behalf of another while he has not performed Hajj for himself, then the Hajj counts for himself, not for the other person. Based on this, we say to this questioner: It is obligatory for you to inform the one who gave you the money that you did not perform Hajj on his behalf. If you performed it and completed the Hajj, your conscience is clear. If you did not do so, you are sinful, and you are liable to guarantee it, and you must provide the guarantee. Yes.
