The Shaykh : The evidence for this is that the udhiyah has specific rulings, among which are: that it must be at a specific time, that it must be of a specific type, that it must have a specific description, and that it must be free from defects. If the intention were merely meat, it would be permissible at any time, of any type, with any description, and whether defective or not. For example, the udhiyah is only valid on the days of slaughter: the day of 'Id al-Adha and the three days following it. On the day of 'Id, it must be after the prayer. It must be of a specific type, namely the livestock of the herd: camels, cattle, and sheep. If one slaughtered a horse and gave it in charity as an udhiyah, it would not be valid. It must be of a specific age: a one-year-old from sheep, or a two-year-old from the rest. If the intention were meat, it would be permissible with a horse or with an animal below the required age. It must be free from the defects described by the Messenger of Allah (peace and blessings be upon him), who said:
Four things are not permissible as sacrificial animals: the one-eyed animal whose blindness is obvious, the sick animal whose sickness is obvious, the lame animal whose lameness is obvious, and the emaciated animal which has no marrow. أربع لا تجوز الأضاحي : العوراء البين عورها والمريضة البين مرضها والعرجاء البين ضلعها والعجفاء أي الهزيلة التي لا تنقي وليس فيها نقي
meaning it has no marrow. If the intention were meat, it would be permissible with this defect, because the blindness of a one-eyed animal does not affect its meat. When you know this, it becomes clear to you that the udhiyah is a prescribed act of worship in itself, not merely giving meat in charity. The Prophet (peace and blessings be upon him) distinguished between a sheep for meat and a sheep for sacrifice, saying:
Whoever slaughters before the prayer, his sheep is a sheep for meat and he has no sacrifice. من ذبح قبل الصلاة فشاته شاة لحم ولا نسك له
This makes it clear that the intention is not merely meat. If that is the case, we see that one should not send udhiyah to Afghanistan or to other poor Muslim countries, because that contradicts the guidance of the Prophet (peace and blessings be upon him). The guidance of the Messenger (peace and blessings be upon him) is for a person to slaughter the udhiyah with his own hand. If he is not able to do so, he appoints someone to slaughter it and witness the sacrifice. From the guidance of the Prophet (peace and blessings be upon him), which Allah commanded, is to eat from it, as the Exalted said:
So eat of them and feed the miserable and poor. فَكُلُوا مِنْهَا وَأَطْعِمُوا الْبَائِسَ الْفَقِيرَ
[Al-Hajj 22:28]
"Eat from it." The original ruling of a command is obligation, and for this reason, some scholars held that it is obligatory for the one who sacrifices to eat from his udhiyah. How can it be obligatory if it is in the East or in the West? From the guidance of the Prophet (peace and blessings be upon him) regarding the udhiyah is to say the name of Allah over it, saying:
In the name of Allah, and Allah is the Greatest. This is from me and for me, on my behalf and on behalf of my household. باسم الله والله أكبر هذا منك ولك عني وعن أهل بيتي
How is this possible if it is in the East or in the West? There is no doubt that if we were to follow the fatwa of this mufti, we would deprive Muslim countries of this ritual, because everyone loves the best. If they were told that the best is to send their udhiyah to such and such a place, Muslim countries would be deprived of this Islamic ritual. Furthermore, among the rulings of the udhiyah is that when the ten days enter, a person is prohibited from taking anything from his hair, skin, or nails until he sacrifices. If you send it to the right or the left, you do not know when they will sacrifice. This fatwa is undoubtedly an error. Whoever wants to benefit his Muslim brothers, let him do so, but not through this Islamic ritual. The rituals remain rituals, and the benefit to Muslims is achieved through another means.
