The questioner : A child whose father died in an accident: Is it permissible for his older brothers to waive the blood money?
The Shaykh : It is permissible for his older brothers and the other adult, mature heirs to waive only their own shares. As for the minors, no one has the right to waive their shares except a person who gives them from his own wealth an amount equal to their share of their father's estate and forgives the killer; in that case, there is nothing wrong with it. The important thing is that he provides them with their full share and does not diminish it in any way.
The questioner : May Allah reward you, O honorable Shaykh, and may Allah bless you and your knowledge, and benefit the Muslims through you.
