The questioner : We bought gold from one of the shops, and then a few days later we wanted to exchange this gold for other gold, and this is according to the agreement on returns or not. So we exchanged it for gold whose value was less than the value of the first gold, and we took the new gold along with the difference in money. Is this sale and purchase permissible, or what? We ask for details on this, O honorable Shaykh, may Allah reward you?

The Shaykh : There is nothing wrong with this if you took the gold and paid the value on the condition that if it suits you, you keep it, and if not, you return it and take its replacement. Because this is an expression of canceling the first sale and renewing another sale. But if there was no agreement between you in the first place, and you bought the gold with certainty, and then afterwards you returned it to the seller and said, "Exchange this gold for us with other gold with the difference," then that is not permissible. Because this is a sale, not a cancellation. And it is established from the Prophet (peace and blessings be upon him) that he said:
Ubida b. al-Simit (Allah be pleased with him) reported Allah's Messenger (ﷺ) as saying: Gold is to be paid for by gold, silver by silver, wheat by wheat, barley by barley, dates by dates, and salt by salt, like for like and equal for equal, payment being made hand to hand. If these classes differ, then sell as you wish if payment is made hand to hand. الذهب بالذهب مثلاً بمثل سواء بسواء يداً بيد
