The questioner : Some individuals who swear by the Prophet (peace and blessings be upon him) and are forbidden from doing so say: We do not believe in exalting [him], but this has become a habit on the tongue. What is the ruling on this? May you be rewarded.

The Shaykh : Before answering this question, it is necessary for us to understand that swearing by other than Allah is shirk (associating partners with Allah).

The questioner : Yes.

The Shaykh : Whether it is by the Prophet, or by an angel from the angels, or by a wali (close friend of Allah) from the awliya (close friends of Allah), or by fathers, or by mothers, or by leaders, or by homelands, or by any created being, swearing by other than Allah is shirk (associating partners with Allah). This is based on the saying of the Prophet (peace and blessings be upon him and his family):
He who swears by anyone or anything other than Allah, has indeed committed an act of Kufr or Shirk من حلف بغير الله فقد كفر أو أشرك

and his saying (peace and blessings be upon him and his family):
to swear by your fathers, so whoever has to take an oath, he should swear by Allah or keep quiet. لا تحلفوا بآبائكم، من كان حالفاً فليحلف بالله أو ليصمت

So, if someone swears by the Prophet (peace and blessings be upon him and his family), we forbid them from doing so because they have done what is shirk (associating partners with Allah). We only have the apparent [evidence], so we disapprove of what appears to us as a contradiction. If he claims that he did not intend an oath, but that it merely slipped from his tongue, we tell him: Accustom your tongue to swear by Allah (Mighty and Majestic), not by the Prophet or by anyone else. And if he accustoms himself, and indeed if he weans himself from what he was accustomed to, which is swearing by the Prophet (peace and blessings be upon him and his family), and then accustoms himself to swear by Allah, and is truthful with Allah (Mighty and Majestic) in his intention and resolve, Allah (Glorified and Exalted is He) will make it easy for him to transition from swearing by the Prophet to swearing by Allah (Glorified and Exalted is He).
Then we say: It is not befitting for a person to swear frequently, for Allah the Exalted says:
And keep your oaths وَاحْفَظُوا أَيْمَانَكُمْ
Some scholars said in its interpretation: Do not swear frequently by Allah. So let a person always be cautious about swearing by Allah, except when there is a need for it or a dire necessity, in which case there is no harm.
As for the fact that he does not say a word, does not report any news, but swears on it, or does not want anything but swears on it, this may lead people to doubt his reports, since he does not tell them anything without swearing.
So we say to thisThe questioner : Stop swearing by the Prophet (peace and blessings be upon him and his family), even if you do not intend an oath and it merely slipped from your tongue. Then accustom your tongue to swear by Allah when there is a need to swear by Allah. Yes.

And I also advise whoever wants to swear by Allah (Mighty and Majestic) to combine his oath with the will of Allah, saying: "By Allah, I will certainly do such and such, if Allah wills," or "By Allah, if Allah wills, I will certainly do such and such." Because if he combines his oath with the will, he gains two benefits. The first benefit is that the matter is made easy for him, and the second benefit is that if he breaks his oath and does not do it, there is no expiation (kaffarah) on him.
In the authentic collections, it is reported from the Messenger of Allah (peace and blessings be upon him) that he informed that the Prophet of Allah, Sulayman ibn Dawud (peace be upon him), said one day: "I will certainly go around tonight to ninety women, and each one of them will give birth to a boy who will fight in the cause of Allah." It was said to him: Say, "If Allah wills." But he did not say, "If Allah wills," relying on the resolve in his heart.
He went around to ninety women فطاف على تسعين امرأة
meaning he had intercourse with them, so none of them gave birth, except one who gave birth to a half-person, meaning half a human being. The Prophet (peace and blessings be upon him and his family) said:
If he had said: 'If Allah wills,' he would not have broken his vow لو قال: إن شاء الله لكان دركاً ليمينه
Sunan an-Nasa'i 3856Sahih (Darussalam)
or he said:
He did not break his oath, and they would have fought in the cause of Allah لم يحنث ولقاتلوا في سبيل الله
So accustom, O brother listener, accustom your tongue when you swear to say: "If Allah wills," so that you obtain these two benefits: the first is the facilitation of the matter, and the second is that if you break your oath, there is no expiation on you. Yes.
