From Abu Shurayh, Wa'il ibn 'Amr al-Khuzai'i al-'Adawi

The Shaykh : From Abu Shurayh. Yes.
The Reciter: From Abu Shurayh, Wa'il ibn 'Amr al-Khuzai'i al-'Adawi (may Allah be pleased with him), that he said:
He said to 'Amr ibn Sa'id ibn al-'As while he was dispatching troops to Makkah: "Allow me, O Prince, to tell you a statement that the Messenger of Allah (peace and blessings be upon him) made the day after the day of the Conquest, and I heard it with my two ears قال لعمرو بن سعيد بن العاص وهو يبعث البعوث إلى مكة ائذن لي أيها الأمير أن أحدثك قولا قال به رسول الله صلى الله عليه وسلم الغد من يوم الفتح فسمعته آذاني
.

The Shaykh : My two ears, my two ears, my two ears.
The reader:
And I heard it with my two ears, and my heart understood it, and my eyes saw it when he spoke it. He praised Allah and extolled Him, then he said: "Indeed, Allah has made Makkah sacred, and the people have not made it sacred. So it is not permissible for anyone who believes in Allah and the Last Day to shed blood in it or to cut down its trees. If anyone takes a dispensation to fight the Messenger of Allah (peace and blessings be upon him), say to him: Indeed, Allah gave permission to His Messenger (peace and blessings be upon him) and did not give permission to you. And I was only given permission for an hour of the day. And its sanctity has returned today as it was yesterday. And let the witness convey to the absent one." It was said to Abu Shurayh: What did he say to you? He said: "I know that better than you, O Abu Shurayh: Indeed, the Haram does not protect a sinner, nor one fleeing with blood, nor one fleeing with khurba فسمعته أذناي ووعاه قلبي وأبصرته عيناي حين تكلم به أنه حمد الله وأثنى عليه ثم قال : إن مكة حرمها الله ولم يحرمها الناس فلا يحل لامرئ يؤمن بالله واليوم الأخر أن يسفك بها دمًا ولا يعضد بها شجرة فإن أحد ترخص بقتال رسول الله صلى الله عليه وسلم فقولوا له إن الله أذن لرسوله صلى الله عليه وسلم ولم يأذن لكم وإنما أُذن لي ساعةً من نهار وقد عادت حرمتها اليوم كحرمتها بالأمس وليبلغ الشاهد الغائب.
فقيل لأبي شريح : ما قال لك؟ قال : أنا أعلم بذلك منك يا أبا شريح : إن الحرم لا يعيذ عاصيًا ولا فارًا بدم ولا فارًا بخرطة

The Reciter: With khurba
Khurba: The khah is closed and the ra is open. It was said: a crime. It was said: a calamity. It was said: an accusation. Its origin is from the theft of camels. The poet said:
"And the thief who loves the thief".

The Shaykh : The author (may Allah have mercy on him) said in his book Umdat al-Ahkam:
The Chapter on the Sanctity of Makkah.
Makkah, and it is also called Bakkah. It is also called Umm al-Qura, and it has names. This land. It is the first house established for people, meaning it was established in it, yes, this land is the land in which the first house established for people was placed. As He (Mighty and Majestic) said:
Indeed, the first House [of worship] established for mankind was that at Makkah إن أول بيت وضع للناس للذي ببكة
[Ali 'Imran 3:96]
. It has a great sanctity. Its sanctity is from within the miles. It is called the boundaries of the Haram.
And it is, praise be to Allah, known, and the Saudi government, may Allah reward them with good, renews it, and it is known.
The author mentioned the hadith of Khuwaylid ibn 'Amr. Read.

The Shaykh : Yes, yes, yes.
The Reciter: From Abu Shurayh, Khuwaylid ibn 'Amr al-Khuzai'i al-'Adawi (may Allah be pleased with him).

The Shaykh : Good, this is Khuwaylid ibn 'Amr al-Khuzai'i, one of the Companions, who said to 'Amr ibn Sa'id while he was dispatching troops to Makkah, meaning he was sending fighters to Makkah, and that was to fight 'Abd Allah ibn al-Zubayr (may Allah be pleased with them both). And 'Abd Allah ibn al-Zubayr was the governor of Makkah and the surrounding areas of the Hijaz.
And the caliphate was with the Umayyads. They saw that 'Abd Allah ibn 'Amr, that 'Abd Allah ibn al-Zubayr, was outside the authority and the caliphate. So they kept sending him troops to fight him, and he is? 'Abd Allah ibn al-Zubayr is one of the noble Companions (may Allah be pleased with them).
This man, Abu Shurayh, said to 'Amr ibn Sa'id - while he was dispatching troops to Makkah, meaning sending fighters to fight 'Abd Allah ibn al-Zubayr in Makkah - :
Allow me, O Prince, to tell you a hadith that the Prophet (peace and blessings be upon him) delivered the day after the day of the Conquest, meaning the second day of the day of the Conquest, and then he mentioned it. Consider the statement of this man, who is a Companion, to this man whom some of the scholars called the open sinner, I mean 'Amr ibn Sa'id, the open sinner. ائذن لي أيها الأمير أن أحدثك حديثا قام به النبي صلى الله عليه وسلم الغد من يوم الفتح يعني اليوم الثاني من يوم الفتح ثم ذكره.
تأمل قول هذا الرجل وهو صحابي لهذا الرجل الذي سماه بعض أهل العلم الفاسق أعني عمرو بن سعيد فاسق.
