I own a piece of land, and in its northwest corner there is a grave whose owner is unknown, and it appears to be very old. What should I do?

The questioner : From Aleppo, Syria. This questioner says: I own a piece of land, and in its northwest corner there is a grave whose owner is unknown, and it appears to be very old. What should I do? May Allah reward you.

The Shaykh : If it is possible to remove this grave, meaning to bring it out from behind the wall, without causing any fitnah (trial, discord or temptation), then that is obligatory. If it is not possible, then it is necessary to refer the matter to the Shari'ah courts, and they will examine the case and then rule as Allah Mighty and Majestic guides them.
