Is it permissible to pray in this mosque where there is a grave in its qiblah?

Machine translationRead the Arabic original
The questioner : There is no mosque there, and I do not hear the call to prayer.

The Shaykh : Yes.

The questioner : And they built one for us in this area in the suburb, which you probably know. I visited my Shaykh there before, at your friend's place—may Allah have mercy on him—Abu Ka'id.

The Shaykh: Yes.

The questioner : Shaykh Kamil, so they built a mosque there, and it was in a cemetery. So they dug up the graves that were there and put them in one grave, approximately in the qiblah of the mosque, and then they built the mosque on top of it.

The Shaykh: Yes.

The questioner : And it was completed. Now, if we hear the call to prayer from this mosque, what do we do?

The Shaykh : You are saying "possible." What is this "possible"?

The questioner : No, there is no "possible." I am saying that we will hear the call to prayer from this mosque.

The Shaykh : Before that, before that, I want to understand: the mosque was built on the cemetery.

The questioner: Yes.

The Shaykh : Yes.

The questioner : These graves were dug up and the bones were extracted.

The Shaykh: Yes.

The questioner : Then they were placed in a grave, approximately in the qiblah of the mosque, on the outside.

The Shaykh: Yes.

The questioner : I mean, we will hear the call to prayer, so what is required of us in this situation?

The Shaykh : If there is no other mosque, and you do not intend to pray in it for a reason that exists in it, which is the graves, you should pray in it. But this grave in which those bones were collected, which is in front of the mosque, should be separated from the wall of the mosque by another wall.

The questioner : There is a separator.

The Shaykh : Did you understand me?

The questioner : Yes, yes, my Shaykh.

The Shaykh : I do not think so.

The questioner : There must be a separator.

The Shaykh : Yes, you are saying there is one.

The questioner : Between the mosque and the grave.

The Shaykh : Yes, there must be a wall between the mosque and the grave.

The questioner : There is one.

The Shaykh : How is there one, my brother?!

The questioner : Because when they collected the bones, the grave was raised above the ground, so they placed the bones and surrounded them with a grave like a room. Yes, my Shaykh.

The Shaykh : You are saying now it is like a room.

The questioner: Yes.

The Shaykh : I mean, is this room on top of the grave?

The questioner: Yes.

The Shaykh : This is another calamity. I am saying that there must be a wall separating the grave from the wall of the mosque, not a wall that is part of the grave itself.

The questioner : Yes, I understood now, my Shaykh.

The Shaykh: All right.

The questioner : Well, can I just have a simple clarification?

The Shaykh: Go ahead.

The questioner : Also, there was a tree, my Shaykh. Some people would come and say that there is a wali (close friend of Allah) there, about three or four years ago, and they would worship at it. So you tell them that as a result of people praying, it returns to this mosque, and it may be a means to this sin in the past.

The Shaykh : Cut down the tree.

The questioner : It was cut down.

The Shaykh : Yes, that is it.

The questioner : Thank you, my Shaykh.

The Shaykh : Welcome.

The questioner : May Allah reward you with good.

The Shaykh : And beware of that.
