The Shaykh : Here is a question: A man saw a car in a showroom, liked it, and wanted to buy it, but he did not have the money. So he came to a merchant and said, “Lend me fifty thousand to buy this car.” The merchant said, “No problem, I will lend you fifty thousand, but it will be on you in installments of sixty thousand.” What do you say about this? Is it permissible or not permissible?

The questioner : It is not permissible.

The Shaykh : It is not permissible. Now, if the merchant says, “I will buy it from the showroom for fifty thousand and sell it to you in installments for sixty thousand,” is that permissible?
This is a ruse that is not permissible. This is a ruse because the matter is one and the same. Its reality is that he lent you its value with an increase, because he did not buy this car except for your sake. Had you not come and said this to him, he would not have bought it.
Yes, if a person has cars that he keeps for the shop, and when a person comes to buy for cash, he says, “Fifty thousand,” and if he says, “I want it in installments,” he says, “Sixty thousand,” there is no harm in that. He is free; he has the right to tell the buyer, “It is fifty thousand cash or sixty thousand in installments,” and the buyer takes it one way or the other. But to say, “Go and choose the car that suits you in the showrooms, then I will buy it at my own expense and then sell it to you,” this is a ruse that is not free of doubt.

The questioner : May Allah reward him with good!

The Shaykh : Yes? This is a loan. We say, instead of saying “I will buy it and sell it to you,” give me fifty thousand as a loan, and then I will pay it back to you.

The questioner : Now, if he says, after he has bought it, “If you wish, take it, and if you wish, leave it.”

The Shaykh : Had he not hoped that you would take it, he would not have bought it! That is the reality. Otherwise, they say and argue that if the merchant buys it, the second party is not obligated. But this second party did not come to ask you except that he was determined to take it. And secondly: if you knew that he would back out, you would not have bought it, without a doubt. For this reason, they say: if he backs out, he is written on the blacklist!

The questioner : Hehehe.

The Shaykh : With the merchant, so that he does not deal with him after this. And this is close to compulsion. Yes, Brother Musa indicates that he has called the adhan, and with it this meeting ends, and we will return, if Allah wills, to another meeting next week.
