The Shaykh :[Al-Ma'idah 5:3] The beasts of prey are like the lion, the wolf, the hyena, and the leopard, meaning any beast of prey. He said in the authentic hadith, the hadith of Ibn 'Abbas, I think: Mishkat al-Masabih 4105 Then he said: [Al-Ma'idah 5:3] His statement: [Al-Ma'idah 5:3] includes everything mentioned before; everything mentioned before is included. So if we find a fallen animal that still has a breath of life and we slaughter it, it becomes lawful, or one that has fallen from a height, or one that has been killed by a blow, or one that has been eaten by a beast of prey. If we find one that has been eaten by a beast of prey and we slaughter it, it becomes lawful, provided that life remains in it, whether it moves or not, according to the stronger opinion. Even if it does not move, if we slaughter it and it does not move but there is life in it, it is lawful. So if a sheep, a camel, or a cow is caught before it dies, even if its neck is broken, and we slaughter it, it becomes lawful. It is not required that it moves with its limbs or any part of it. But if someone asks, "Then what tells us that it is alive if its movement is not a condition? What makes us know?"

The Shaykh : It is not that it has no soul. They say that if the blood comes out, meaning it flows red, that is evidence that it has not died. If it is black and comes out slowly, it is dead. This is the sign. So the sign is by the blood. If we catch it before it dies and slaughter it with a lawful slaughter, it becomes lawful.
and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death]
وما أكل السبع إلا ما ذكيتمGod’s messenger prohibited every beast of prey with a fang
نهى النبي صلى الله عليه وسلم عن كل ذي ناب من السباعProhibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death], and those which are sacrificed on stone altars, and [prohibited is] that you seek decision through divining arrows. That is grave disobedience. This day those who disbelieve have despaired of [defeating] your religion; so fear them not, but fear Me. This day I have perfected for you your religion and completed My favor upon you and have approved for you Islam as religion. But whoever is forced by severe hunger with no inclination to sin - then indeed, Allah is Forgiving and Merciful.
