The Shaykh : And this last one that we read today contains a benefit, which is his statement: if it mixes with dogs on which the name of Allah was not mentioned, it indicates that if the dogs had the name of Allah mentioned over them, the game would be eaten. Is that clear? That is, for example, Zayd sends his dog, 'Amr sends his dog, and Khalid sends his dog, and the dogs meet on a piece of game. In that case, this game is lawful because the name of Allah was mentioned over all of them. But to whom does this game belong? Do we say it belongs to the owner of the dog that is in its mouth, because that is the apparent case? However, if we see these dogs hunting it all together, then their owners own it as partners, because it was hunted for them. It is also derived from this hadith that if a person is absent for a day or two and finds nothing in it but the trace of his arrow, it is lawful. Based on what? Based on the apparent evidence, because the apparent reality is that it did not die except from this cause. Even though there is a possibility that it died from something else, this is the apparent reality. And from this we derive another benefit: if a child is sleeping with his mother and he is sick, and when morning comes he is found dead, it is possible that he died because she rolled over on him, and it is possible that he died from the illness that afflicted him. It is attributed to the illness that afflicted him, and it is said to the mother: be at ease, for he may have died from this illness. As long as there is something apparent, let the ruling be based on it. Now, if he was not sick and she found him dead next to her and said it is possible that she rolled over on him and killed him, it is said: there is no blame on her, because the original state is the innocence of the soul and the absence of killing. And death during sleep is common, as Allah the Exalted said:
Allah takes the souls at the time of their death, and those that do not die [He takes] during their sleep الله يتوفى الأنفس حين موتها والتي لم تمت في منامها
[Az-Zumar 39:42]
meaning He takes their souls in their sleep
Then He keeps those for which He has decreed death and releases the others فيمسك التي قضى عليه الموت ويرسل الأخرى
