The Open Door Meeting Series-161b

Machine translationRead the Arabic original
The Shaykh : He says: What is the answer to the hadith narrated by 'Amr ibn Shu'ayb from his father from his grandfather that the Prophet (peace and blessings be upon him) said:
If a man has authority over a woman, her giving is not permissible except with his permission إذا ملك الرجل المرأة لم تجز عطيتها إلا بإذنه
Sunan al-Bayhaqi 6:36
They said: It is not permissible for a woman to give charity without her husband's permission. And they answered regarding the hadith of the festival that it was a command from the Prophet (peace and blessings be upon him), so it does not serve as evidence for permissibility, and it is also a specific incident?
The answer is that Allah, Glorified and Exalted is He, said:
And give the women [upon marriage] their [bridal] gifts graciously. But if they give up willingly to you anything of it, then take it in satisfaction and ease. وآتوا النساء صدقاتهن نحلة فإن طبن لكم عن شيء منه نفساً فكلوه هنيئاً مريئاً
[An-Nisa 4:4]
This indicates that a woman is free in her wealth. And this hadith narrated by 'Amr ibn Shu'ayb, either it is said to be anomalous because it contradicts the authentic hadiths, or it is said to be on the path of recommendation only.
