The Shaykh : And his statement: Zayd ibn Thabit said, is mentioned only because he (may Allah be pleased with him) is among the most knowledgeable people regarding the law of inheritance. As for the hadith:
The most presumptuous of you is Zayd أفرضكم زيد
, it is weak and not authentic from the Prophet (peace and blessings be upon him). Even if it were authentic, it addresses a specific group of people and does not address the entire Muslim community. And even if it addressed the entire Muslim community, this does not mean that Zayd is infallible from error, even if he is the most knowledgeable in the community regarding inheritance, because no one is infallible from error except the Messenger (peace and blessings be upon him).
I said this because some scholars stated: What Zayd said regarding the law of inheritance is obligatory to follow, because the Prophet (peace and blessings be upon him) said:
The most presumptuous of you is Zayd أفرضكم زيد
.
The answer to this view is from three aspects:
First: The weakness of the hadith. This is important, meaning that the authenticity of the transmission that establishes a ruling or negates it is very important.
Second: Even if it were authentic, it addresses a specific group of people.
Third: Even if it were authentic and general, it does not imply that Zayd is infallible, even if he is the most knowledgeable in the community regarding inheritance, because no one is infallible except the Messenger of Allah (peace and blessings be upon him).
Based on this, we say that Zayd’s (may Allah be pleased with him) school of thought regarding the inheritance of the grandfather and siblings is not binding on us. It is weak, as will be mentioned if Allah wills. The correct view is that the grandfather, the father of the father, is in the position of the father; he blocks all siblings, and no one of them inherits with him.
As for the issue he mentioned, it is clear: "If a man or woman leaves behind a daughter, she gets half. If there are two or more daughters, they get two-thirds. If there is a male with them, he is given his share first, and what remains is for the male in the amount of two females' shares".
