The punishment for drinking intoxicants is not a fixed Qur'anic punishment but a discretionary punishment

The Shaykh : With this explanation, we have come to know that the punishment for drinking intoxicants is not a fixed Qur'anic punishment, as is the well-known view among most scholars, but rather a discretionary punishment. However, it should not be less than forty lashes, because there is no report that it is less than forty. As for increasing it, there is no harm in exceeding forty lashes, as 'Umar (may Allah be pleased with him) did.
