The benefits of the hadith of al-'Asif.

Machine translationRead the Arabic original
The Shaykh : This hadith also provides evidence for the permissibility of the Imam delegating the establishment and execution of the hadd punishment, based on his statement:
If she confesses فإن اعترفت
This is the establishment of the hadd,
then stone her فارجمها
This is the execution and implementation of the hadd. It also provides evidence that it is not required to repeat the confession of zina four times, based on his statement:
If she confesses فإن اعترفت
and he did not say "four times, then stone her." The reconciliation between this and the story of Ma'iz is that the Prophet (peace and blessings be upon him) had doubt regarding the case of Ma'iz. Another perspective is that this story, may Allah know best, became famous and well-known, which is why there was back-and-forth discussion between the common people and the scholars, unlike the story of Ma'iz, which was established by his statement and confession after repentance. It also contains his statement:
O Unais! Go to the wife of this (man) واغد يا أنيس إلى امرأة هذا
Sahih al-Bukhari 2314, 2315
and that in delegating a future matter, it is not required to say "if Allah wills." This does not contradict the saying of Allah the Exalted:
(23) And never say of anything, "Indeed, I will do that tomorrow," (24) Except [when adding], "If Allah wills." ولا تقولن لشيء إني فاعل ذلك غدا إلا أن يشاء الله
[Al-Kahf 18:23-24]
We have mentioned in this issue what one should be aware of, which is that if a person says "I will do such and such," if his intention is to inform about what is in his heart, he is not required to make the exception, meaning he is not required to say "if Allah wills" ...
