The Book of Hajj-03b

Machine translationRead the Arabic original
The reciter: The chapter on what is done for a person in the state of ihram who dies. Abu Bakr ibn Abi Shaybah narrated to us, he said: Sufyan ibn 'Uyaynah narrated to us, from 'Amr, from Sa'id ibn Jubayr, from Ibn 'Abbas (may Allah be pleased with them both), from the Prophet (peace and blessings be upon him):
a person fell down from his camel (in a state of Ihram) and his neck was broken and he died. Thereupon Allah's Apostle. (ﷺ) said: Bathe him with water mixed with the leaves of the lote tree and shroud him in his two (pieces of) cloth (Ihbram), and do not cover his head for Allah will raise him on the Day of Resurrection Pronouncing Talbiya.
Sahih Muslim 1206a
.
The Shaykh: This happened on the Day of 'Arafah. This man fell and broke his neck, meaning he died. So they came to ask the Prophet (peace and blessings be upon him): What should they do with him? So he guided them, and he (peace and blessings be upon him) said:
Bathe him with water mixed with the leaves of the lote tree and shroud him in his two (pieces of) cloth (Ihbram), and do not cover his head for Allah will raise him on the Day of Resurrection Pronouncing Talbiya. اغسلوه بماء وسدر وكفنوه في ثوبيه ولا تخمروا رأسه فإن الله يبعثه يوم القيامة ملبيًا
Sahih Muslim 1206a
.
There are other wordings of this that will come later.
In this is evidence for asking about what a person does not know, and that this is the way of the Salaf, and that a person should not rely on mere opinion devoid of ijtihad, because they asked the Prophet (peace and blessings be upon him). If they had intended to do what is done for the dead in other circumstances, they would have done so, but they feared that the ruling might change, and it did change.
