The Shaykh : I mean, the wife is taken to the husband. It was the opposite with us; the husband was the one who came to the wife. But now, through the wedding halls as they call them, neither the husband nor the wife comes; both come to this hall and he takes her there. This is one of the customary, ordinary matters. However, some scholars said that if the husband is waiting for his wife to be handed over to him, he is excused for missing the congregation. For example, if he says, "Hand her over tonight," and he waits for them after the Maghrib prayer until the time for the Isha' prayer arrives and they have not come, he is waiting for them. They said he is excused for missing the congregation. They took this from the saying of the Messenger (peace and blessings be upon him)

In this hadith is evidence that it is permissible for a father to marry off his young daughter. A young girl under the age of nine does not have a valid consent. Do we take this as a general rule, or do we say this applies if such a case is found and not otherwise? The answer is the second: this is not taken as a general rule, especially in our present time when women are like goods in the hands of their guardians, and a person sells her to whomever he wishes and whenever he wishes without caring. Based on this, we say that it is not permissible for a person to marry off his young daughter absolutely. Why? Because the young girl does not have consent and does not know about this matter. If a person were to ask his six-year-old daughter's permission and say, "Do you know I am going to marry you off?" she does not know what marriage is at all, so she does not have consent. When she reaches the age of nine, she has consent. Therefore, she is not to be married off except with her permission and agreement. This is what the scriptural evidence requires, especially in our present time with the lack of trustworthiness and following of desires. Yes.
